My Family AgreementsChild support agreements

Write down what you’ve both agreed, in plain words you can keep.

You set out the child support you’ve both agreed, from regular payments to school fees and other costs. Those answers become an agreement you both read before anyone signs.

How it works

Agreements are made under the Child Support (Assessment) Act 1989 (Cth).

Built from the answers you both give

Two kinds of agreement

Binding and limited agreements

The law allows two kinds of child support agreement. They work differently, and both are available here.
Includes legal advice

Binding child support agreement

Sets child support at an amount you both agree on, which can be more or less than an assessment would set.

  • Before signing, each parent gets independent legal advice from a different lawyer on our panel, who signs a certificate to confirm it.
  • It stays in place until you replace it with a new agreement or end it together, or until a court sets it aside.
  • Neither parent can change it on their own.
Assessment needed first

Limited child support agreement

Sets child support at or above the amount in a child support assessment that is already in place.

  • A child support assessment has to be in place before you make it.
  • The amount can’t be lower than the assessment.
  • Legal advice isn’t required, although either parent can still get it.
  • Once it has run for three years, either parent can end it by giving notice.

You choose the type when you start, and the questions that follow are the ones that type needs. See how it works

Questions

Common questions

Do we both need to use the site?
Yes. Each parent has their own account, answers the questions about themselves and reads the agreement before signing. The other parent sees what you’ve entered, so you’re both working from the same information.
Does My Family Agreements give legal advice?
No. We prepare the agreement from your answers. For a binding agreement, each parent gets independent legal advice from a lawyer on our panel before anyone signs.
Does this cover where the children live?
No. A child support agreement deals with money for the children. Where they live and how time with each parent is shared are parenting arrangements, set out in a parenting plan or parenting orders, and this site doesn’t prepare those.
What happens after we sign?
A child support agreement has to be accepted by Services Australia (Child Support) before it takes effect.
